Japanese Knotweed is one of the UK’s most invasive, non-native plant species and poses significant problems.

Its aggressive growth can damage structures and outcompete native vegetation. Small clumps quickly become dense thickets, due to their fast-growing rhizomes (roots). Japanese Knotweed regenerates from small fragments of its roots and stems, so it is easily spread by attempts to remove it.

It is not illegal to have Japanese Knotweed, but it is an offence to allow it to spread from your land to someone else’s land.

Legal Implications of Having Japanese Knotweed On Your Property

Due to its negative impacts, Japanese Knotweed is subject to various legal controls.

  1. Japanese Knotweed is an invasive non-native plant listed on Schedule 9 of the Wildlife and Countryside Act 1981, making it an offence to plant or cause Japanese Knotweeed to grow in the wild.
  2. The Anti-social Behaviour, Crime and Policing Act 2014 covers invasive non-native plants, including Japanese Knotweed. You can be prosecuted if you allow it to spread off your land.
  3. Japanese Knotweed (and soil containing it) is regarded as ‘controlled waste’ under the Environmental Protection Act (Duty of Care) Regulations.
  4. Mortgage applications and property transactions can be affected by Japanese Knotweed. Since 2013, a seller is required to state whether Japanese Knotweed is present on their property through a TA6 form, the property information form used for conveyancing.

It is not an offence to have Japanese Knotweed growing in your garden, but it is an offence to plant or cause it to grow in the wild. You should take steps to prevent its spread. Additionally, a relevant environmental authority can order control measures if they deem such action necessary.
